Terms of Use
Last updated
Anchor is an independent project built by a small team. These terms are the deal between you and us. They are written to be read, so please read them. If you do not agree with them, do not use Anchor.
1. Accepting these terms
These Terms of Use are a binding agreement between you and the maintainers of Anchor ("Anchor", "we", "us"), meaning the people who together run the site. By creating an account, signing in, or using any part of the site, you accept these terms and our Privacy Policy. If you use Anchor on behalf of anyone else, you promise you are allowed to bind them, and "you" means both of you.
Section 17 contains a binding arbitration clause and a class action waiver. It affects how disputes between you and us are resolved. Please read it carefully.
2. Who may use Anchor
You may use Anchor only if all of the following are true.
- You are at least 13 years old.
- If you are under the age of majority where you live, your parent or legal guardian has read these terms and agrees to them on your behalf.
- You have never been banned from Anchor, and are not evading a ban.
- You are not barred from using the site under any applicable law or sanctions list.
We may ask you to confirm your age or identity at any time, and may suspend or close an account while we wait for an answer. If we learn that an account belongs to someone under 13, we will close it and delete the associated personal data.
3. Your account
You are responsible for everything that happens on your account, including anything done by someone you shared it with, and including anything done by someone who guessed or stole your password. Keep your password to yourself, use a strong one, and tell us promptly if you think someone else has access.
Accounts are personal. You may not sell, rent, lend, gift or transfer an account, and you may not buy one. Any account involved in a transfer may be closed without notice and without compensation to anybody involved.
Usernames, display names and group names are licensed to you for use on Anchor and are not property. We may reclaim, rename or reassign any of them at any time, for any reason, including inactivity, impersonation, trademark complaints, or because we would simply rather the name were free.
4. What Anchor is, and is not
Anchor is an independent project, built and run by a small team outside of any company. It is experimental software, developed continuously, and offered to you exactly as it happens to be working at the moment you load it.
We are not affiliated with, endorsed by, sponsored by, or connected to Roblox Corporation or any other company, and nothing on the site should be read as suggesting otherwise. Product names and trademarks belong to their respective owners.
We make no promise that Anchor will be available, that it will keep working, that data will be preserved, that features will continue to exist, or that the site will exist at all tomorrow. Downtime, data loss, rollbacks, wipes and permanent shutdown are all possible outcomes of running a project like this, and you accept that risk as a condition of using the site.
5. Your content
"Your content" means anything you upload, create, post, publish or send through Anchor: games, models, images, audio, clothing, avatars, group pages, forum posts, messages, names and descriptions.
You keep whatever ownership you already had in your content. You are responsible for it, and you promise that you have the rights you need to upload it and to grant the licence below, and that it does not infringe anyone's rights or break any law.
You grant us a worldwide, non-exclusive, royalty free, fully paid, perpetual, irrevocable, transferable and sublicensable licence to host, store, cache, reproduce, adapt, modify, translate, reformat, publish, publicly display, publicly perform, distribute and otherwise use your content, in any medium now known or later invented, for the purposes of operating, developing, promoting and improving Anchor. This licence survives the closure of your account and the deletion of your content, to the extent copies remain in backups, caches, logs or in the possession of other users.
You waive, to the fullest extent permitted by law, any moral rights or rights of attribution you may hold in your content as used on Anchor.
We are under no obligation to store, back up or return your content, and we may remove or refuse any of it at any time for any reason or no reason.
If you send us feedback, suggestions or ideas, we may use them freely, without attribution, compensation or obligation of any kind.
6. Our content
The site itself, its code, design, layout, text, graphics and marks are ours or our licensors' and are protected by copyright and other laws. We grant you a personal, limited, revocable, non-transferable, non-exclusive licence to use Anchor for its intended purpose. That is all. Everything not expressly granted is reserved.
You may not copy, scrape, mirror, resell, reverse engineer, decompile, or build a competing service from the site or its data, and you may not use automated systems to access it beyond what a normal person with a browser would generate, except where that restriction is prohibited by law.
7. Points, items and anything else virtual
Points, currency, items, hats, clothing, layouts, badges, serials, inventories, trades and every other virtual thing on Anchor are a licence to use a feature of the site. They are not property. You do not own them. They have no monetary value, no cash value, and no value outside Anchor.
We may, at any time and without notice, liability or compensation:
- change what any virtual item does, looks like, costs, or is called;
- reduce, increase, revoke, reset, duplicate or delete any balance or inventory;
- reverse any transaction, including one completed by mistake or by an exploit;
- retire an item, make it unavailable, or issue more of a limited item;
- discontinue virtual items entirely.
Nothing bought, earned, won or traded on Anchor is refundable, exchangeable or redeemable for money or anything of value, including where an account is closed, a feature is removed, or the site shuts down.
Trading or selling accounts, items or currency for real money, cryptocurrency or anything else of value outside Anchor is forbidden. We are not a party to any such arrangement, we will not honour or reverse it, and we may close every account involved.
8. Payments
Where Anchor offers anything for payment, payment is processed by a third party processor under its own terms, and we never see or store your full card details. All charges are final and non-refundable except where a refund is required by law.
You are responsible for any taxes. If a payment is reversed, charged back or disputed, we may remove whatever it bought, suspend the account, and recover what is owed.
9. Rules of conduct
Do not do any of the following, and do not help anyone else do them.
- Post anything illegal, or anything that sexualises a minor. We report this to the authorities without warning you.
- Harass, threaten, stalk, dox, impersonate or incite violence against anyone, on or off the site.
- Post malware, phishing pages, scams, or links to any of those.
- Upload content you do not have the rights to, or that infringes copyright, trademark, privacy or publicity rights.
- Exploit bugs, duplicate items or currency, use cheats, bots, scrapers or automated clients, or interfere with anyone else's use of the site.
- Attack, overload, probe or attempt to gain unauthorised access to the site, its servers, or any account that is not yours.
- Circumvent moderation, rate limits, bans or age checks.
- Advertise, sell, solicit or run a business through the site without our permission.
- Collect other users' personal information.
If you find a security vulnerability, please report it to us privately and give us a reasonable chance to fix it before telling anyone else. Do not access other people's data while investigating.
10. Moderation and termination
We may moderate, review, filter, hide, edit, delete or refuse any content, and we may warn, restrict, suspend, ban, close or delete any account, at any time, for any reason or no reason, with or without notice, and without any liability to you or anyone else.
We are not obliged to moderate anything, and the fact that content is on the site does not mean we have reviewed or approved it. We may keep records of removed content and of closed accounts for as long as we consider useful.
You may stop using Anchor at any time and may ask us to close your account. Closure does not entitle you to any refund or to the return of anything, and does not end the sections of these terms that by their nature should survive, including sections 5, 6, 7, 14, 15, 16, 17, 18 and 19.
11. Changes to Anchor and to these terms
We may add, change, restrict, suspend or remove any part of Anchor at any time, and we may stop running the site permanently, without notice and without owing you anything.
We may change these terms at any time. When we do, we will update the date at the top of this page, and where the change is significant we will make a reasonable effort to tell you through the site. Continuing to use Anchor after a change means you accept the new terms. If you do not accept them, stop using the site and close your account.
12. Third party content
Anchor hosts content made by other users and links to sites we do not control. We do not endorse any of it, we are not responsible for it, and your dealings with other users or with third party sites are entirely between you and them. Check any third party's own terms and privacy policy before you use it.
13. Copyright complaints
If you believe content on Anchor infringes your copyright, send a notice to legal@anchor.rip containing all of the following.
- Your physical or electronic signature.
- Identification of the work you say has been infringed.
- A link to the material on Anchor, precise enough for us to find it.
- Your name, address, telephone number and email address.
- A statement that you believe in good faith that the use is not authorised by the owner, its agent or the law.
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorised to act for them.
We remove infringing material and terminate repeat infringers. If your content was removed and you believe that was a mistake, you may send a counter notice to the same address. Knowingly misrepresenting that material is infringing may make you liable for damages.
14. Disclaimers
ANCHOR IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED AND STATUTORY, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY AND NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WE DO NOT WARRANT THAT ANCHOR WILL BE UNINTERRUPTED, SECURE, TIMELY, ACCURATE, FREE OF ERRORS OR HARMFUL COMPONENTS, THAT DEFECTS WILL BE CORRECTED, THAT DATA WILL BE PRESERVED OR RECOVERABLE, OR THAT THE SITE WILL MEET YOUR REQUIREMENTS. NO ADVICE OR INFORMATION, ORAL OR WRITTEN, CREATES ANY WARRANTY NOT EXPRESSLY STATED HERE.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you. In that case those warranties are limited to the minimum duration and scope the law permits.
15. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER ANCHOR NOR ITS OPERATOR, CONTRIBUTORS, MODERATORS, VOLUNTEERS OR SUPPLIERS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, CONTENT, VIRTUAL ITEMS, USE OR OPPORTUNITY, WHETHER THE CLAIM IS BROUGHT IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR ANY OTHER THEORY, AND EVEN IF WE HAVE BEEN TOLD SUCH DAMAGES WERE POSSIBLE.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATING TO ANCHOR IS LIMITED TO THE GREATER OF THE AMOUNT YOU ACTUALLY PAID US IN THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR FIFTY UNITED STATES DOLLARS.
These limits apply to everything connected with Anchor, including its unavailability, the loss or deletion of any account, content or virtual item, the conduct of other users, unauthorised access to your account or data, and the permanent shutdown of the site.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or under any consumer protection law that applies to you and cannot be waived. Some jurisdictions do not allow the exclusion of incidental or consequential damages, so parts of this section may not apply to you.
16. Indemnification
You will defend, indemnify and hold harmless Anchor, its operator, contributors, moderators and volunteers from and against any claim, demand, investigation, loss, liability, damage, cost and expense, including reasonable legal fees, arising out of or connected with your content, your use of Anchor, your breach of these terms, or your violation of any law or of anyone else's rights.
We may take over the defence of any matter subject to this section at your expense, and you will not settle anything that imposes any obligation on us without our written consent. This section survives the closure of your account.
17. Disputes, arbitration and class action waiver
READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO GO TO COURT AND TO HAVE A JURY DECIDE YOUR CLAIM.
17.1 Talk to us first
Before starting any formal proceeding, you agree to email legal@anchor.rip with a short description of the dispute and what you want, and to give us sixty days to resolve it informally. This step is a condition of starting arbitration. The limitation period is paused while it runs.
17.2 Binding arbitration
If we cannot resolve it, you and we agree that any dispute arising out of or relating to Anchor or these terms will be resolved by final and binding individual arbitration, rather than in court, except as stated in 17.4. The arbitration will be administered by a recognised arbitration provider under its consumer rules then in force, before a single arbitrator, conducted in English, and where possible by written submissions or video rather than in person.
The arbitrator decides all issues, including the scope, enforceability and formation of this agreement to arbitrate, except that a court decides whether 17.3 has been broken. The arbitrator may award only the relief a court could award to you individually, and the award is final and enforceable in any court with jurisdiction.
17.3 No class actions
YOU AND WE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY INDIVIDUALLY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED, REPRESENTATIVE OR PRIVATE ATTORNEY GENERAL PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS OR PRESIDE OVER ANY FORM OF REPRESENTATIVE PROCEEDING. YOU AND WE ALSO WAIVE ANY RIGHT TO A JURY TRIAL.
If this paragraph is found unenforceable as to a particular claim or remedy, that claim or remedy is severed and heard in court, and the rest stays in arbitration.
17.4 What is not covered
Either of us may bring an individual claim in small claims court if it qualifies, and either of us may ask a court for an injunction or other equitable relief to stop infringement or misuse of intellectual property, unauthorised access, or breach of section 6 or 9.
17.5 How to opt out
You may reject this arbitration agreement by emailing legal@anchor.rip with the subject line "Arbitration opt-out", your account name, and a clear statement that you opt out, within thirty days of first accepting these terms. Opting out has no effect on anything else in these terms, and we will not treat you differently for doing it.
17.6 Time limit
Any claim relating to Anchor must be brought within one year after it arises, or it is permanently barred, unless the applicable law forbids shortening that period.
18. Governing law
These terms and any dispute arising from them are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws rules. Where a dispute is not subject to arbitration, you and we submit to the exclusive jurisdiction of the state and federal courts sitting in New Castle County, Delaware.
If you are a consumer resident in the European Union, the United Kingdom or another place whose law gives you the protection of your local courts and mandatory local rules, nothing here takes that away from you.
19. General terms
Entire agreement. These terms and the Privacy Policy are the whole agreement between you and us about Anchor, and replace anything said before.
Severability. If any part is held unenforceable, it is limited or cut to the minimum extent needed and the rest stays in force.
No waiver. If we do not enforce something, that is not a waiver of it.
Assignment. You may not assign or transfer these terms. We may assign them freely, including to a successor or acquirer, without notice.
Force majeure. We are not liable for any failure or delay caused by anything beyond our reasonable control, including hosting failures, network outages, attacks, power cuts, acts of government, and acts of nature.
No third party rights. Nobody other than you and us has any right to enforce these terms.
Relationship. These terms do not create any partnership, employment, agency or joint venture between us.
Notices. We may give you notice through the site or by the email address on your account. You give us notice at the address in section 20.
20. Contact
